Elyvo (ABN 72 584 931 772) is operated by Joseph Esposito as a sole trader based in Queensland, Australia. We are committed to protecting personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

By using our website or services, you consent to the practices described in this policy.

We collect personal and business information that you provide when engaging our services, including:

• Name, email address, phone number, job title, and organisation name
• Business intelligence profile — sector themes, key messages, tone of voice, target audiences, media contacts, and topics to monitor
• Information submitted through our onboarding form or electronic signature system
• Technical information collected automatically when visiting our websites (browser type, pages visited)

Personal information is used to:

• Deliver communications intelligence services, including scheduled intelligence briefs and content streams
• Generate and deliver Media Moment Packs when requested by the Client
• Manage billing and issue invoices, including invoices for Media Moment Pack add-ons
• Send legal documents and agreements
• Respond to enquiries and provide support

We do not sell personal data to third parties or use it for unrelated marketing purposes.

We use third-party service providers that may process personal information outside Australia. These providers are based in the United States and include:

By engaging our services, you expressly consent to the disclosure of your personal information to these overseas providers for the purposes of service delivery. Elyvo takes reasonable steps to ensure these providers comply with the Australian Privacy Principles or equivalent protections.

Client data including intelligence profiles and brief history is stored locally in the operator's browser using browser-based storage. This data is not transmitted to Elyvo's central servers. Users are responsible for securing their own devices and browser sessions.

Elyvo applies reasonable technical and organisational safeguards to protect personal information, including HTTPS encryption on all websites and session-only storage of API credentials. No method of electronic storage or transmission is completely secure and we cannot guarantee absolute security.

Personal information is retained only for as long as necessary to deliver our services and meet our legal obligations. Data is deleted upon request where practicable, subject to any legal obligation to retain it.

Elyvo complies with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth). In the event of an eligible data breach, we will:

• Contain the breach as quickly as practicable
• Assess whether the breach is likely to result in serious harm
• Notify affected individuals as soon as practicable
• Notify the Office of the Australian Information Commissioner (OAIC) within 30 days
